These Terms of Service ("Terms") constitute a legally binding agreement between you and Emploit ("Company," "we," "our," or "us") regarding your use of the Emploit platform ("Service"), an AI-powered voice interviewing platform.

By accessing or using our Service, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Service.

Service Description

Emploit is an AI-powered platform that enables organizations to conduct automated voice interviews using voice cloning technology, natural language processing, and fraud detection capabilities.

User Accounts and Registration

Account Creation

• You must provide accurate and complete information during registration
• You are responsible for maintaining the confidentiality of your account credentials
• You must notify us immediately of any unauthorized use of your account
• You must be at least 18 years old to create an account

Account Types

• Recruiters/Organizations: Create and manage AI interviews
• Candidates: Participate in interviews as invited by organizations
• Enterprise: Multi-user accounts with advanced features and controls

Acceptable Use Policy

Permitted Uses

• Conducting legitimate hiring and recruitment activities
• Using the Service in compliance with applicable laws and regulations
• Creating voice clones for your own recruiting purposes
• Processing candidate data with proper consent and legal basis

Prohibited Uses

• Using the Service for any illegal, harmful, or discriminatory purposes
• Creating voice clones without proper authorization
• Attempting to circumvent fraud detection or security measures
• Reverse engineering, decompiling, or attempting to extract source code
• Using the Service to harass, abuse, or discriminate against candidates
• Sharing access credentials or violating usage limits
• Introducing viruses, malware, or other harmful code

Subscription and Billing

Subscription Plans

• Various subscription plans are available as described on our pricing page
• Features and usage limits vary by plan tier
• Interview credits are consumed per completed interview session
• Enterprise plans may include custom terms and pricing

Billing Terms

• Subscriptions are billed monthly or annually in advance
• Payments are non-refundable except as required by law
• You authorize us to charge your payment method for applicable fees
• Failed payments may result in suspension or termination of service

Free Trial

• Free trials are available for new accounts only
• Trial limitations apply as specified during registration
• We may require payment information for trial activation
• Trials automatically convert to paid subscriptions unless cancelled

Intellectual Property Rights

Our Rights

• Emploit platform, software, and technology are owned by Emploit
• All trademarks, logos, and brand names are our property
• We retain all rights not expressly granted to you
• You may not use our intellectual property without written permission

Your Content

• You retain ownership of content you upload to the Service
• You grant us a license to use your content to provide the Service
• You represent that you have the right to use all uploaded content
• Voice recordings are used solely for creating your personalized AI interviewer

AI-Generated Content

• Interview questions and responses generated by our AI are provided "as-is"
• You are responsible for reviewing AI-generated content for appropriateness
• We do not guarantee the accuracy or suitability of AI-generated content
• Final hiring decisions remain your sole responsibility

Data Processing and Privacy

Data Controller Responsibilities

• You are the data controller for candidate data processed through our Service
• You must obtain necessary consents and provide required notices to candidates
• You must comply with applicable data protection laws (GDPR, CCPA, etc.)
• You are responsible for the lawfulness of data processing activities

Our Role as Data Processor

• We process data solely as instructed by you through the Service
• We implement appropriate technical and organizational security measures
• We provide tools for data subject requests and data management
• Data Processing Agreements are available for enterprise customers

Service Availability and Support

Service Level

• We strive to maintain high service availability but do not guarantee 100% uptime
• Scheduled maintenance will be announced in advance when possible
• Emergency maintenance may occur with limited notice
• Enterprise customers may have specific SLA agreements

Support

• Email support is provided to all users
• Response times vary by subscription plan
• Enterprise customers receive priority support
• We do not provide support for third-party integrations unless specifically agreed

Disclaimers and Limitations

Service Disclaimers

• The Service is provided "as-is" and "as-available" without warranties
• We disclaim all warranties, express or implied, including fitness for a particular purpose
• We do not warrant that the Service will be uninterrupted or error-free
• AI-generated content may contain inaccuracies, errors, or biases

Limitation of Liability

• Our liability is limited to the maximum extent permitted by law
• We are not liable for indirect, incidental, or consequential damages
• Total liability shall not exceed the amount paid by you in the 12 months preceding the claim
• These limitations apply regardless of the theory of liability

Indemnification

You agree to indemnify and hold harmless Emploit and its affiliates from any claims, damages, or expenses arising from: (a) your use of the Service, (b) your violation of these Terms, (c) your violation of applicable laws, or (d) your processing of candidate data through the Service.

Termination

Termination by You

• You may cancel your subscription at any time through your account settings
• Cancellation takes effect at the end of your current billing period
• You remain responsible for all charges incurred before cancellation
• You may request data export before account deletion

Termination by Us

• We may suspend or terminate your account for violation of these Terms
• We may terminate the Service with 30 days' notice
• We may immediately suspend accounts for security or legal reasons
• Upon termination, your right to use the Service ceases immediately

Governing Law and Disputes

Governing Law

These Terms are governed by and construed in accordance with the laws of the jurisdiction where Emploit is incorporated, without regard to conflict of law principles.

Dispute Resolution

• We encourage informal dispute resolution through direct communication
• Any disputes shall be resolved through binding arbitration where permitted by law
• Class action lawsuits are waived to the extent permitted by law
• Enterprise customers may have specific dispute resolution procedures

General Provisions

Changes to Terms

We may update these Terms periodically. Material changes will be communicated through email or platform notifications. Continued use after changes indicates acceptance of updated Terms.

Severability and Entire Agreement

• If any provision is found unenforceable, the remainder shall remain in effect
• These Terms constitute the entire agreement between you and us
• Enterprise customers may have additional terms in separate agreements
• Our Privacy Policy is incorporated by reference
